USERS
Access and/or use of this CAPTIA portal attributes the condition of USER, who accepts, from this access and/or use, the General Conditions of Use reflected herein. The mentioned Conditions shall be applicable independently of the General Contracting Conditions which, where applicable, are mandatory.
USE OF THE PORTAL
www.captia.es provides access to a multitude of information, services, programmes or data (from now, "the contents") on the Internet belonging to CAPTIA or its licensors to which the USER may have access. The USER assumes responsibility for the use of the Portal. This responsibility extends to any registration which may be necessary to access certain services or content. In such registration, the USER shall be responsible for providing truthful and lawful information. As a consequence of this registration, the USER may be provided with a password for which he/she shall be responsible, undertaking to use it diligently and confidentially. The USER undertakes to make appropriate use of the content and services (such as chat services, discussion forums or newsgroups) that CAPTIA INGENIERÍA S.L.U. offers through its portal and, by way of example but not limited to, not to use them for (i) engaging in activities that are illicit, illegal or contrary to good faith and public order; (ii) disseminating content or propaganda of a racist, xenophobic, pornographic-illegal, apology of terrorism or against human rights; (iii) cause damage to the physical and logical systems of CAPTIA INGENIERÍA S.L.U., its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage; (iv) attempt to access and, where appropriate, use the email accounts of other users and manipulate their messages. CAPTIA INGENIERÍA S.L.U. reserves the right to remove all comments and contributions that violate the respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that violate youth or childhood, public order or safety or that, in its opinion, are not appropriate for publication. In any case, CAPTIA shall not be responsible for the opinions expressed by users through forums, chats or other participation tools.
PRIVACY POLICY
CAPTIA processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). Details of the processing of personal data collected through this website are set out below.

Data we process and its source
We process the data that the user provides directly through the website forms (for example, name, company, e-mail address, telephone number and the content of the message) and, where applicable, browsing data obtained through cookies and similar technologies when the user gives consent (see the Cookie Policy). No special categories of data are collected. The data comes from the data subject.
Purposes and legal basis of the processing
- To handle requests for information and contact made through the forms. Legal basis: consent of the data subject and/or performance of pre-contractual measures (art. 6.1.a and 6.1.b GDPR).
- To manage job applications submitted through the "Work with us" form. Legal basis: consent of the data subject (art. 6.1.a GDPR).
- To send commercial communications about our products and services, where the user consents. Legal basis: consent (art. 6.1.a GDPR and art. 21 LSSI-CE).
- Analytics and improvement of the website through analytics cookies. Legal basis: consent (art. 6.1.a GDPR).
Retention periods
Data will be kept for as long as necessary to handle the request and, thereafter, for the periods legally required to address possible liabilities. Data processed on the basis of consent will be kept until the data subject withdraws it. Job applications will be kept for a maximum of one year.
Recipients and processors
Data will not be disclosed to third parties except where legally required. Data may be processed by service providers acting as data processors (web hosting, form management and analytics), with whom CAPTIA enters into the corresponding contracts pursuant to Article 28 GDPR. These providers include Raiola Networks S.L. (web hosting, with servers in Spain), Deftform (form management) and Google (analytics and maps).
International data transfers
The hosting provider (Raiola Networks) processes data in Spain, so it does not involve an international transfer. Other providers (for example, Google) may process data outside the European Economic Area, mainly in the United States. In such cases, transfers are covered by the safeguards provided for in the GDPR: standard contractual clauses (Implementing Decision (EU) 2021/914) and, where applicable, the provider's certification under the EU-U.S. Data Privacy Framework.
Rights of data subjects
The user may exercise the rights of access, rectification, erasure, objection, restriction of processing and portability, as well as withdraw any consent given at any time, by contacting hola@captia.es, indicating the right they wish to exercise and enclosing a copy of a document proving their identity. Users also have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if they consider that the processing does not comply with the regulations. CAPTIA will respond to requests within a maximum of one month from receipt, extendable in accordance with Article 12 GDPR.
Commercial communications
In accordance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), CAPTIA will request the user's consent to send commercial communications by electronic means. The user may object or unsubscribe free of charge at any time.
Security measures
In accordance with Article 32 GDPR, CAPTIA applies appropriate technical and organisational measures to ensure the security of personal data and to prevent its alteration, loss, or unauthorised processing or access, including the encryption of communications via HTTPS/TLS protocols and restricted access to information.
Minors
This website is not directed at minors under 14 years of age. CAPTIA does not knowingly collect data from minors of that age; if it is detected that a minor's data has been provided without the corresponding consent, it will be deleted.
Changes to the privacy policy
CAPTIA may amend this policy to adapt it to legislative or case-law developments, publishing the version in force on this website at all times.
INTELLECTUAL AND INDUSTRIAL PROPERTY
CAPTIA itself or as an assignee, is the owner of all intellectual and industrial property rights of its website, as well as of the elements contained therein (including but not limited to images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by CAPTIA or its licensors.
All rights reserved. According to the provisions of articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including making available, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorisation of CAPTIA, are expressly prohibited. The USER undertakes to respect the Intellectual and Industrial Property rights owned by CAPTIA. The USER may view the elements of the Portal and even print, copy and store them on the hard drive of his/her computer or any other physical medium, provided that this is solely and exclusively for his/her personal and private use. The USER shall refrain from deleting, altering, evading or manipulating any protection device or security system installed on the pages of CAPTIA.
EXCLUSION OF WARRANTIES AND LIABILITY
CAPTIA shall not be liable, under any circumstances, for damages of any kind that may be caused by, but not limited to: errors or omissions in the content, lack of availability of the portal or the transmission of viruses or malicious or harmful programs in the content, despite having taken all the necessary technological measures to prevent it.
MODIFICATIONS
CAPTIA reserves the right to make any modifications it deems appropriate to its website without prior notice, and may change, delete or add content and services provided through the same as well as the way in which they are presented or located on its website.
LINKS
In the case that www.captia.es contains links or hyperlinks to other Internet sites, CAPTIA shall not exercise any type of control over said sites and content. Under no circumstances shall CAPTIA assume any responsibility for the contents of any link belonging to another website, nor shall it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, accuracy, truthfulness, validity and constitutionality of any material or information contained in any such hyperlinks or other Internet sites.
Moreover, the inclusion of these external connections shall not imply any kind of association, merger or participation with the connected entities.
RIGHT OF EXCLUSION
CAPTIA reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, at its own request or at the request of a third party, to those users who do not comply with these General Conditions of Use.
GENERAL
CAPTIA will pursue the breach of these conditions as well as any improper use of its website, exercising all civil and criminal actions that may correspond to it by law.
USE OF ARTIFICIAL INTELLIGENCE
In the development and maintenance of this website, as well as in the layout and editing of certain content, CAPTIA may use artificial intelligence tools. The published content is reviewed and remains the responsibility of CAPTIA. This website does not incorporate high-risk artificial intelligence systems within the meaning of Regulation (EU) 2024/1689 (Artificial Intelligence Act), nor AI systems that interact directly with the user; should any be incorporated in the future, appropriate information will be provided in accordance with the applicable transparency obligations.
APPLICABLE LAW AND JURISDICTION
The relationship between CAPTIA and the USER shall be governed by current Spanish legislation. Prior to any legal action, and in accordance with Organic Law 1/2025 of 2 January on measures for the efficiency of the Public Justice Service, the parties may resort to an appropriate means of dispute resolution (MASC). Any dispute shall be submitted to the Courts and Tribunals of the city of Madrid.
